On Monday, Robinson sat before Utah Judge Tony Graf as Kirk’s parents and his widow, Erika Kirk, watched from the gallery. According to CNN, the appearance marks the first time the family has been in the same room as Robinson since his arrest last year.
Over the next week, Judge Graf will evaluate the evidence presented by the state to decide if prosecutors have established enough probable cause to bring the case to a full criminal trial.
The hearing comes nearly 10 months after the fatal September 2025 shooting that claimed the life of the 31-year-old co-founder of Turning Point USA while at a speaking event at Utah Valley University.
On Monday, prosecutors began outlining their case by calling their first witness, Christopher Bagley, a former senior officer with the UVU Police Department. Bagley recounted the immediate aftermath of the shooting.
“I asked dispatch to get on the camera system and to see if anybody was on top of the Losi building during the time of the incident,” Bagley testified. “People were screaming, standing up, and starting to run in all different directions away from the center of the tent.”
Robinson surrendered to police the day after the shooting. While he has not yet entered a formal plea, he faces multiple severe charges, including aggravated murder. Prosecutors have already signaled their intent to seek the death penalty if Robinson is convicted at trial.
